    Here's something from his website. I am not one hundred percent sure of what he will do but I do remember him talking about increasing EB GCs early on in his presidency bid.

    I agree, Durbin will push for H1B restrictions and that is bad, but I think EB GCs may be safe according the the above.

    Friends,
    I need to find out how many people are interested in pursuing this option, since the whole interfiling/PD porting business (based on a year 2000 memo) can seriously undermine the EB2 category.

    I am currently pursuing some initial draft plans with some legal representation, so that a sweeping case may be filed to end this unfair practice. We need to plug this EB3-to-EB2 loophole, if there is any chance to be had for filers who have originally been EB2.

    More than any other initiative, the removal of just this one unfair provision will greatly aid all original EB2 filers. Else, it can be clearly deduced that the massively backlogged EB3 filers will flock over to EB2 and backlog it by 8 years or more.

    I also want to make this issue an action item for all EB2 folks volunteering for IV activities.

    I guess i am old school. I like to live within my means and own things in the true sense of owning. Read a lot about leveraging and know if not used correctly you get into financial meltdown we have now.

    I know really smart people make lot of money using this leveraging model. I wish you the best and hope you own 10 homes so that you can donate some to your grandchildren also.

    I will be happy owning one home. And hope to repay it off quickly so i dont have any BANK to answer to. Having a peace of mind that one day when i pay off the home nobody can kick me off my home for any reason is PRICELESS to me.

    Owning 10 homes so that you can donate to your grandkids may be PRICELESS to you. I wish you the best.

    here is another point:
    if you want to remain a slave to the GC process and ristrict your career by staying with a company..just because you dont want to lose your PD...then..god save u and ur future..


    the person who ports his PS was already in the line..he reclaimed his rightful place after going thru the due deligence...of restarting his GC process...in fact ppl.

    i am sure ..after oct they will offer some relief to Eb3 category...


    i think its a childish and selfish idea...i agree labor substitution was absolute nonsense...but not PD porting!

    Why did they not take the employer to court? Why make the EB2 line suffer for these employer's faults?

    If an employer wrongly files your case under EB3 instead of EB2 or EB1, then the onus is on you to challenge them and take them to court if need be.

    I felt the same way before. I said to myself I wouldn't buy a house until I get my GC. That was until a builder offered me a nice offer. I was renting a two bedroom apartment for $1200 as I have a family with 3 small kids.

    The builder offered me a 2,600 sq. ft., 4 bed-room home at $1450 per month, including taxes and insurance, fixed for 30 years. I guessed that the $250 difference from rent is nothing compared to the benefit of owning a home. The interest part of my first monthly amortization is about $800, $400 go to principal, and $250 go to taxes and insurance.

    Have you done your math ? Granted those $250 looks chump change for you, but what if it was invested for a return of 5% while the house may not be back at sales level for another 10 to 15 years ?

    No one will argue with you about buying a house for yours kids pleasure though.

    Sorry .. I don't understand ... You are complaining to DOS for USCIS and DOL discrepancies ? They don't care ..different departments really..

    Had they cared July fiasco wouldn't have happened...


    This is the first time, EB3-I is speaking up. Please don't stop us.

    DOS and USCIS both are tied together. I think we should send this letter to both DOS and USCIS and request them to distribute spillover numbers equally between EB3 and EB2 category or similar.

    After going through this post
    I checked my I 94 last entered in 2006 it has different number than other I 94
    I am working with only one company since 2004
    They wrote company name src number correct on I 94
    but number is not same as the one on I 797 bottom totally different

    should i get it corrected ? How

    I am all for cleaning the system and reforming H1B - but I oppose an ill conceived half measure such as the one Senator Durbin/Grassley is proposing.

    My main concern is two fold:
    1. Let us assume I am a very bright individual and I am currently in Harvard. If I graduate from Harvard Business School, and I want to join McKenzie, can I do that? Can I ever be a Management consultant in US if I want to (read I as any random Joe who is not US citizen/GC holder)

    2. Can I switch jobs within a couple of weeks if I need to (I refers to someone who works for a good company but perceives opportunities else where) - this is important as my competition (US citizen/GC holder) has no restriction in place for them. This is also important during recession when I might be a valuable asset to another company but the company cannot afford to wait.

    My point is: definitely prevent abuse of the system, but not by putting more shackles on the hapless employee. Give the employee freedom to move anywhere for a certain period of time (could be 3 yrs renewable 2 times as per current H1b) and have strict penalties if this employee overstays visa etc.

    Additionally, if employers abuse the system, send them to jail right away (and have whistle blower immigrant status protection). Make employers more accountable than they are today.

    Just my 2 cents.....
    matter of fact is the spinelesss legislators can only go after the individual(employees), and lick the a** ot corporate America.

    IV ' s position is - Opposing the Bill, if some members think otherwise, so be it.

    Prefer to refrain from adding fuel to Sunny's reply as this thread is causing more rift than good.

    You will never learn. Anyways, if you read my earlier posts you would know that I have said that people who most people who live in apartments would be having valid reasons. I have also said that if I were in CA. I would be living in an apartment too. I am never against renting or living in an apartment, but I am against renting when it makes perfect sense to buy and when the time is right (which of course is NOT NOW).

    My counter arguments are for people who were scaring people into not buying a house when things are conducive for them. Note, when I say conducive it means all things considered as in the time is right, they have a good job, have found a very good deal in a location having a very good school and they have found something which has an extra room when their elderly parents visit them.

    No one is scaring away others from buying a house. We are all pointing to the risk of buying a house at this time, which you are already agreeing. :)

    My situation goes something like this.

    1) I got 7th year extension in Sep 2005
    2) Visited India and got stamped and got new I-94 on return.
    3) Applied for 8th year extension without submitting new I-94.
    but applied with old replacement I-94 came with I-797.
    4) So the same I-94 continued on subsequent I-797 extensions.
    5) Recently applied for 9th year extension with the same.

    My Question is, do I need to submit last entry I-94 card that I missed which is expired now, for correction? Or is there any issue with this.
    All these years I have the same employer.

    I appreciate your help on this.

    There are two things

    1. when you got your 7th year extension 797 with I 94 , you were supposed to submit that I 94 ( on 797) along with the i 94 in your passport.
    This is important most people dont do it .
    2. when u aplied for 8th year extension u submitted the 797 of the 7th year along with the i 94 attached to it( which you were suppose to submit when you left the country for 7th year stamping) hence the I 94 number did not change. Your I 94 are out of synch.

    I would suggest to talk to an immigration attorney and i mean a real good one .
    Otherwise you could talk to an immgration officer and expalin your case.
    Or you could now go out get stamped and get a new I 94 9make sure this time you submit both the I 94s when you leave)

    I had a very peculiar situation where i had to travel outside the country when my H1 extension was pending and it got approved when i was out of the country and when i got a new i 94 when i came back with a new number than the one with i 94 on 797 ( which was of a later date)
    I spoke to immigrtaion officer and he heard me my circumstances and said i was in status and my i 94 were in order.
    Last year i went to my home country and got stamped and got a new i 94 but i submiited the two i 94s when i left the country.

    what a fantasy land we are in. Do you know what an Executive order from the President means? if any one on the forum has the influence to get an Executive order from the President then this retrogression would not have existed at all.

    It may be possible to the Sec.of DHS or the President to issue an executive order to allow a "processing grace period" that extends the visa allotment past Sep30th for a given year for those cases where processing had already begun on or before Sep30th.

    This is a small incremental step - but it may help with using up a few 1000 extra numbers.

    Legions of patriotic Americans look for "made in USA" stickers before buying products, out of a desire to support the country's economy.

    But what if we all were restricted to purchasing only those goods that were made in America?

    Our homes would be stripped virtually bare of telephones, televisions, toasters and other electronics, and many of our favorite foods and toys would be gone, too. Say goodbye to your coffee or tea, and forget about slicing bananas into your breakfast cereal -- all three would become prohibitively expensive if we relied on only Hawaii to grow tropical crops.

    We'd have to trash our beloved Apple products because the iPod, iPad and MacBook aren't made in the U.S. Gasoline would double or triple in price, given that we now import more than 60% of our oil. And you couldn't propose to your true love with a diamond ring: There are no working diamond mines in the U.S.

    Moreover, a complete end to imports would actually hurt the U.S. economy, because consumers and domestic companies would lose access to cheap goods. Trade protections, whether through tariffs or quotas, cost the economy roughly $2 for every $1 in additional profit for domestic producers, said Mark Perry, an economics professor at the University of Michigan-Flint and a visiting scholar at the American Enterprise Institute, a conservative think tank.

    "If we restricted trade to just the 50 states, what would happen immediately -- and would increase over time -- would be a huge reduction in our standard of living, because we wouldn't have access to the cheap goods we get from other countries," Perry said. "We also wouldn't have any export markets, so companies like Caterpillar and Microsoft would have a huge reduction in sales and workforce."

    So what do we make of heartfelt pleas to save U.S. manufacturing by buying American, or the many websites (see one here) that catalog U.S. sources for an array of products? Or the Buy American Act, which curbs government purchases of products that are made overseas?

    Do such efforts actually hurt the country they're trying to help?

    The argument for buying American

    Marc Kruskol, 53, a publicist based in Palmdale, Calif., goes out of his way to purchase products that are made in the U.S. because of his concern over the decline in manufacturing employment.

    "I truly believe that we could go a long way towards fixing the economy if we would just put people to work making things in this country that are made in other places," said Kruskol, who spends hours scouring made-in-America websites or visiting brick-and-mortar stores in search of U.S. products.

    He recently spent $10 on a pair of salad tongs made in America, which he tracked down in a restaurant supply store, after rejecting 99-cent foreign-made tongs. And he was happy to spend $650 on a domestically produced barbecue grill rather than a $450 imported one, just to support his countrymen.

    But financial experts say that it's best for America if you buy the cheapest product you can find without sacrificing quality. Their explanation rests on the concept of efficient manufacturing. An efficient producer creates the most valuable goods with the least possible expense, selling those items at lower prices than competitors who are less efficient. A country benefits when its manufacturers become more efficient.

    When you spend more on an equivalent product simply because it's made in the U.S., you're wasting your money -- and supporting an inefficient manufacturer that, by rights, should become more efficient or go out of business. Moreover, the additional $9.01 or $200 that Kruskol had spent on an inefficient U.S. producer could have been spent on something else, helping the economy further. Or it could have stayed in his savings account and been funneled by his bank into the financial system, which in theory allocates capital to the most efficient producers.

    "He gave effectively $9 to an inefficient producer to motivate them to keep producing inefficiently," said Ken Fisher, the founder and CEO of Fisher Investments in Woodside, Calif., and the author of "Debunkery." "I understand the well-intentioned view. Doing that would be terrible for America."

    The most efficient producers are best-positioned to create more jobs and return profits to their investors, and to the government in the form of tax revenue. "We make the country better by allocating resources towards the ones that can use them best," Fisher said.

    The complex manufacturing question

    At the heart of the issue are the interconnected global economy and the changes in the manufacturing sector.

    There's no question that U.S. manufacturers employ far fewer people now -- about 11.7 million in April -- than when the sector peaked at 19.6 million workers in 1979. But the decline in jobs is largely due to technological advances that have reduced the number of workers needed to run factories, Perry and Fisher pointed out. The average worker today is responsible for $180,000 of manufacturing output, triple the inflation-adjusted $60,000 of 1972, Perry said.

    Despite that increase in productivity, a March report by IHS Global Insight put China's manufacturing output ahead of the U.S. for the first time ever, at $2 trillion in 2010, compared with $1.95 trillion for the U.S. That's up from $1.69 trillion for China and $1.733 trillion for the U.S. in 2009, based on U.S. and Chinese government data.

    But Perry argued that exchange-rate fluctuations and differences in data sources caused the IHS Global report to skew the comparison between the U.S. and China. Based on U.N. data for 2009, the most recent available, the United States' manufacturing output was 14% ahead of China's, he said.

    Moreover, as manufacturing has declined as a share of the U.S. economy while the service sector has grown, most of the world has followed the same trend. The proportion has held steady in China.

    "We've left the Machine Age, and we're in a new Information Age. It makes sense that manufacturing would be less important," Perry said, noting that as other countries have taken over clothing and other low-end manufacturing, the U.S. has become more competitive in producing pharmaceuticals, software, aerospace technology, industrial machinery and medical equipment. "We're still world leaders and at the cutting edge of those higher-skilled, higher-valued-added areas."

    Not convinced yet? The other conundrum in trying to buy only U.S.-made products lies in what that really means.

    Do you accept products that are assembled in America but contain components from all over the globe? For example, U.S. companies in February imported $58 billion worth of industrial supplies, such as petroleum and plastics, and $40 billion in capital goods, from computers to engines and laboratory equipment.

    What about products that are assembled in China yet include parts from U.S. suppliers and were designed by American engineers? Every time you purchase such an item, the money will flow back to those American engineers and suppliers.

    Cars.com's American-Made Index illustrates U.S. industries' complex trade relationships. The website ranks vehicles built and purchased in the U.S. based on sales, the origin of the cars' parts and whether assembly was in the U.S. The top two cars -- Toyota Camry and Honda Accord -- are produced by Japanese companies through their U.S. subsidiaries.

    "On the surface, it seems like it might be plausible to have these 'made in the USA' campaigns," Perry said. "It all gets real tricky in a global economy with parts."

    When buying American helps

    That's not to say you should ignore the origins of the goods you buy.

    When comparing two products of equivalent price and quality, feel free to choose the U.S.-made one out of domestic pride. It may make sense to buy a U.S.-made product if the quality or safety is superior.

    Alex Kaplan, 41, the owner of Celebrity Laser Spa in Los Angeles, recently bought a pair of ottomans online for $120, only to find them cracked and cheaply made. After returning the made-in-China set, he found a craftsman through Etsy who made similar ottomans for $160 but allowed customers to choose the fabrics.

    "It's much more satisfying," said Kaplan, whose blog chronicles his attempts to find products made in the U.S. "The most important thing when it comes to buying American is being aware and asking yourself, 'Where is this made?'"

    Atleast you are being honest and telling that the price now is somewhere around 350K. also the main point is that you bought it in 2004 so you are somewhat lucky. the situation now is such that prices are still very high in the correct location. I will give my example ..if I buy a house now ... for the good deals ..I have to buy one which is 14 miles away from work and another 22 miles away from city / airport (atlanta). and ofcourse if I buy at so far away it will not appreciate for another 10 years (many places have single roads ..and atlanta traffic is famous). there is still a bubble at better locations ..as sellers / builders are not lowering enough ..lots of for sale signs though.
    now by renting ..I am closer to work / family ..so atleast 250 $ saved in gas plus vehicle maintenance ..add another 300 in maint + hoa for new house plu 300 - 400 in prop tax etc. with this money itself --I get good deals on renting a townhome with good apartment companies (hence no HOA).
    so renting is not throwing money away ..you get a place to stay (with no maintenance) ..maybe smaller in size ..so you need to ask another question ,...do I need extra space (And maintenance ..) ..before you decide to buy especially now.

    I am moving to Atlanta (Meritta) soon. I got new job there.

    I need some advise regarding housing situation in regards to buying home. Currently I dont own home. I went to buy home last spring at my current location ( south carolina) but luckily I didnt buy it as some one advised me not to proceed unless I plan to stay for atleast five years. So that was good for me.

    Any way what are the good developing suburbun areas where we have good schools and property prices are reasonable in atlanta area?

    What is the trend of house price in atlanta area?

    Also regarding renting apratments, my son is in high school and I will be working in the Meritta area. I was looking for highshools and I found that Walton highschool, Pope Highschool and Roswell Highschools may be good choices nearby.

    Let me know your experiences in regards to any of those schools and nearby renatl apartments at low cost. I currently rent twobed room apartment and similar mightbe sufficient for me.

    Also please give links where I can see more info regarding atlanta housing, shcools transport etc.

    Half a dozen freshman Democrats took to the House floor one late-October morning to cast their lot with Republicans.

    Their actions went unpunished by the Democratic leadership that day, as they have on many other occasions in recent weeks. The symbolic gesture -- casting nay votes on approving the House Journal, essentially the minutes of the previous day -- would have no bearing on the leadership's agenda.

    While they overwhelmingly support that agenda, the bloc of freshmen has begun casting votes against such minor procedural motions in an effort, Democratic sources and Republican critics say, to demonstrate their independence from their leadership. The number of votes that the potentially vulnerable newcomers to Capitol Hill cast against House leaders is tallied and watched closely by interest groups and political foes.

    Such is the political life of many of the 42 freshman House Democrats, a sizable number of them moderates and conservatives who must straddle the fence between supporting their party's interests and distancing themselves from a mostly liberal leadership as they gear up for their first reelection battle next fall.

    House Speaker Nancy Pelosi (D-Calif.) and other members of the party's leadership are happy to tolerate the independence on procedural matters. Less than three hours after opposing the late-October journal vote, the same six freshmen sided with Pelosi as Democrats tried, and failed, to override President Bush's veto of a bill to expand the State Children's Health Insurance Program by $35 billion over five years, legislation that Pelosi has called her "crown jewel."

    "I'm viewed as an independent. I'm viewed as a conservative Democrat," said Rep. Jason Altmire (Pa.), the first freshman to regularly oppose his party's leadership on the journal vote.

    Like several others, Altmire offered no explanation for voting against all but one of 18 roll calls on the routine measure, adding that he had no "pre-planned" rationale for the votes. "I'm certainly not going to win or lose my reelection based on my journal votes," he said.

    But the first reelection campaign in his conservative-leaning western Pennsylvania district could be a tough one. Bush won there by a comfortable nine percentage points in 2004. Districts such as Altmire's fueled the Democratic takeover of the House last year. They are blue-collar in attitude and red-hued in politics, particularly on issues such as abortion and gun rights.

    Dubbed the "majority makers" by Pelosi's leadership team, the freshmen have become a major front in the Democrats' battle to sustain and expand their majority next fall.

    Stuart Rothenberg, an independent analyst and author of the Rothenberg Political Report, said Republican hopes for shrinking the Democratic majority begin with what he calls "snapback candidates," who rode into office under the last election cycle's optimal conditions for Democrats and now face their first reelection contests.

    Protecting the 42 freshman Democrats, the largest partisan class since 73 Republicans took office in 1994, has been the top priority for key Democratic strategists such as Rep. Rahm Emanuel (Ill.). The freshmen get special treatment from leaders, including a weekly meeting with Pelosi and Majority Leader Steny H. Hoyer (Md.). And they receive frequent advice on how to vote from Emanuel and Rep. Chris Van Hollen (Md.), chairman of the Democratic Congressional Campaign Committee.

    Seven of the rookies have more than $1 million in cash on hand, and according to Rothenberg, more than half are in safe positions to win reelection. In addition, the Democratic Congressional Campaign Committee holds a more than 11-to-1 cash advantage over its Republican counterpart, a potential financial backstop for endangered freshmen.

    But the political environment has turned toxic in recent months as Democrats have been stymied in their effort to take Congress in their self-proclaimed new direction. Opinion polls show public approval ratings for Congress mired in the 20s, considerably lower than Bush's rating.

    In recent months, Democrats in battleground districts have been criticized by Republicans, who have tried to paint them as close to the new House leadership.

    "While these Democrats might claim to be independent voices for their districts, the differences between them and Nancy Pelosi are purely aesthetic," said Ken Spain, spokesman for the National Republican Congressional Committee. This year, the GOP committee launched a Web site to track the percentage of votes that 28 of the freshmen cast with Pelosi, whom Republicans say will be a polarizing figure in conservative districts next fall.

    That is why procedural votes are important to freshmen, according to Democratic aides. House Republicans this year turned to a procedure known as a "motion to recommit," offering what is typically a routine method of sending bills back to committee as politically charged amendments. With a wink and a nod from Emanuel and Hoyer, some endangered freshmen frequently vote with Republicans on tricky GOP motions to keep their votes from being used against them in 30-second campaign sound bites.

    Some freshman Democrats have taken the idea of voting against their party leadership on procedural votes one step further, opposing mundane matters such as the journal vote.

    Altmire has sided with the opposition in 17 of 18 journal roll calls this year. Rep. Joe Donnelly (D-Ind.) has cast 15 votes with the GOP. In the spring, only a few freshmen voted against the journal, but one recent vote drew 13 freshmen in opposition, and in another, 11 voted nay. Now a half-dozen or more regularly oppose whenever a roll call is held.

    Democratic leaders acknowledge that they have encouraged the freshmen to sometimes vote with Republicans on politically difficult issues, but deny that they have had any input on the Congressional Record votes.

    "We've given them very simple advice: Make sure you vote your district," Van Hollen said.

    As a result, Rep. Heath Shuler (D-N.C.), for example, has one of the lowest party-unity voting scores -- less than 84 percent -- of any House Democrat, according to washingtonpost.com's congressional database. The average House Democrat has voted with the majority on 92.5 percent of all votes.

    "They're trying to create separation. Our guys did it in '95 and '96," said Rep. Thomas M. Davis III (R-Va.), a member of the GOP class of 1994.

    At the time, freshman Republicans saw congressional popularity plummet during a budget fight that led to a series of federal government shutdowns. Fearful of being tied closely to then-Speaker Newt Gingrich (R-Ga.), many freshmen also began voting no on the journal in a similar effort to distance themselves.

    In fact I am so relaxed and laughed many times for the past 2 days. I read so many jokes and picked the good ones, I really enjoyed doing this.

    May be their receipt dates are close.. Remember, CIS can't sort the application by PD. They can process in FIFO of RD.

    Nope...was keeping an eye on that too. Sent PMs to a few and could see no trend in the receipt date/notice date either.
